Please read these terms and conditions carefully. The conclusion of the contract between the an individual or an entity(commonly referred to as "Customer") and Agenda Tour Company( referred to as « Agenda Tour »), whether written or oral, implies that the customer has read, understood and accepted these terms and conditions.
Agenda Tour is committed to providing all the services listed in the selected tour. Agenda Tour is also willing to offer certain services upon request such as assisting the visa application process or modifying the itinerary based on the customer’s preferences.
The proposed rates are valid for the duration specified by Agenda Tour in tariff, invoice or other documents delivered to the customer. During the validity period, these rates can be adjusted due to unpredictable changes including, but not limited to excessive fluctuation of exchange rates, recently enacted tax, increase in transport costs or any other similar events. If Agenda Tour cannot organize the tour with initial rates, an adjustment request will be sent to the customer. In case the customer rejects the request, Agenda Tour reserves the right to cancel the tour and reimburse the deposit excluding the bank charge that the customer had paid.
The customer must confirm the selected tour with the consultant in charge of his case. The customer will be asked to complete a booking form and return it to Agenda Tour . Then, Agenda Tour will proceed to book all services related to the tour and reserve the right to propose equivalent alternatives in case one or more services such as accommodation, train and domestic flights are found unavailable.
Once all reservations are made, the final travel itinerary will be sent to the customer. A deposit of 10% of the total trip cost must then be paid to Agenda Tour , as specified by the consultant in charge of the relevant case.
Occasionally, a deposit of 25% of the total tour cost may be required at the last-minute booking during high season. Unless previously agreed by Agenda Tour , any failure to pay the deposit within 15 days from the day the customer receives the final itinerary may result in cancelation of all services booked. The request will be deemed to be cancelled by the customer and the provisions mentioned in Section 7 will be applied.
Unless otherwise stated by Agenda Tour , the customer must pay the balance either before or at the beginning of the tour.
In the event of any breach of the obligation to pay the balance stated above, the customer’s request will be deemed void and the provisions mentioned in Section 7 will be applied.
a. Modification from the customer
The customer may request tour modification at any time, provided that the customer and Agenda Tour reach an agreement about expenses incurred by modification. Agenda Tour is commited to responding to such requests with the utmost diligence, subject to availability of the required services.
The arrival delay is deemed a modification.
Reduced number of travelers is not deemed a modification. Cancellation penalty will be charged for those withdrawing from the tour and the tour price will be re-evaluated accordingly for the remaining travelers.
b. Modification from Agenda Tour
Agenda Tour reserves the right to modify services included in the final tour in these following cases:
- The modification is due to a force majeure event. In this case, the modification may result in an additional charge to the customer or Agenda Tour , under certain circumstances, may bear the incurred cost.
- The modification is necessary to ensure the customer’s safety or the trip’s quality. In these cases, additional costs that may be incurred are the responsibility of Agenda Tour .
a. Cancellation from the customer
The customer must pay the penalty charge equal to:
- 5% of the total trip cost if the cancellation is received by Agenda Tour at least 45 days from the start date of the trip.
- 10% of the total trip cost if the cancellation is received by Agenda Tour within 45 days from the start date of the trip.
In case of cancellation of a trip that had been postponed, a penalty of 10% of the total trip cost will be charged regardless of the cancellation date. If the cancellation is made prior to the deposit payment, an invoice penalty charge will be sent to the customer according to the above conditions which are also stated on the quote accepted by the customer.
If the cancellation is made after the deposit payment, Agenda Tour shall deduct the relevant penalty charge from the deposit already paid by the customer and reimburse the remaining amount, if applicable, by bank transfer with the customer ‘s consent regarding bank fee.
b. Cancellation from Agenda Tour
Agenda Tour reserves the right to cancel the trip, in all or in part due to the occurrence of force majeure , i.e unforeseen or unavoidable events that make travel impossible or dangerous including, but not limited to war, war threat, riot, natural disasters, port blockade, looting, fire, terrorist activity, adverse weather conditions, epidemics, quarantine or any similar events.
In all cases of cancellation, Agenda Tour is liable to reimburse the customer, if applicable, additional costs generated by these events such as cancellation fees charged by hotels, airlines or any other service suppliers as well as bank fees. However, the customer will in no case be entitled to compensation.
Before beginning the trip, the customer should follow these requirements in terms of:
• Passport (valid for a minimum period of 6 months past the return date ).
• Permits and certificates including vaccination certificates
• Visa (required for Vietnam, Laos, Cambodia ).
Agenda Tour may assist the customer with the process of obtaining the visa upon request.
The customer travelling with Agenda Tour must purchase travel insurance covering at least international medical expenses and repatriation costs.The details of the insurance provider and insurance policy number must always be communicated to Agenda Tour prior to the start date of the trip.
During the course of the trip, the customer must comply with the rules announced by the guide or other travel agents.These are the rules to ensure the safety and quality of the tour.
Agenda Tour is committed to providing all possible assistance to the customer upon the occurrence of events covered by insurance, including the administrative formalities with the competent authorities and the insurer.
Agenda Tour is committed to providing the customer all the services mentioned in the tour.
Any activity that is not mentioned in the tour and any law violation committed by the customer in the host country is not under the responsibility of Agenda Tour .
Agenda Tour serves as an intermediary between the customer and the various service suppliers such as air carriers, hotels, restaurants. In any case, Agenda Tour will strive to ensure the best quality of services, but should not be confused with the various suppliers, who are, in any event, responsible for their services.
Agenda Tour is not responsible for the consequences resulting from a force majeure event.
Agenda Tour does not reimburse for unused services in the tour. However, if the tour is interrupted in whole or in part due to health reasons, Agenda Tour is committed to making every effort to request reimbursement from service suppliers for all or part of unused services.
Any complaint related to the services included in the tour must be submitted in writing to Agenda Tour within 20 days from the end of the trip.
Any dispute between the customer and Agenda Tour must be initially solved through negotiation. Both parties should strive to seek an amicable solution to their dispute.
If Agenda Tour agrees to compensate, the compensation amount, in any case cannot exceed the total trip cost excluding airfare charged to Agenda Tour . This condition applies if Agenda Tour fails to meet its contractual obligations.
In all other cases, Agenda Tour reserves the right not to offer compensation to the customer at its own discretion.
If no amicable solution can be found, the court of the place where the contract is concluded will be competent to decide.
Agenda Tour accepts payment in Euros, American dollars or Vietnamese Dongs.
a. Secured online payment
The customer can pay by credit card via a secure payment system online. An additional fee of 4% of the total amount is also at the customer’s expense.
The customer can also pay by bank transfer. Agenda Tour’s bank account information will be provided at the time of contract signing. The bank fee that is set by the customer's bank and that of Agenda Tour is the responsibility of the customer.
c. Credit Card
The payment by credit card is only possible for the balance settlement. The following card types are accepted: Visacard, Mastercard, American Express, JCB Card and Diners Club. The payment plus transaction surcharge is made at Agenda Tour office. The transaction fee is 3% of the total amount for Visa card and Master card, 4% for American Express and 3.3% for JCB and Diners Club Card.
d. Cash Payment
Cash payment can be made at the office of Agenda Tour or of travel agents. The cash payment is not subject to any charge.
